This is a courtesy translation. The Spanish version (“Política de Reembolsos”) is the legally binding one and prevails in case of any discrepancy.

This Policy forms part of the sgatt.app Terms and Conditions of Use. We run it so that you know with certainty, before paying, when we return your money and when we do not. Nothing in this Policy limits the rights granted to you by the Mexican Federal Consumer Protection Law (Ley Federal de Protección al Consumidor).

1. How access works

We sell access for fixed periods (30 days, 120 days, and a 60-day extension). There is no subscription and no automatic renewal: when the period ends we do not charge you anything further. You can cancel the Service immediately through [CANCELLATION PATH OR BUTTON IN YOUR ACCOUNT], with the effects and refund rights shown to you before you confirm. This Policy governs the return of the amount paid for a purchase. Where the statutory withdrawal right of Article 56 of the Federal Consumer Protection Law applies, you may exercise it within 5 business days from the date of your purchase, in accordance with that article, through support@sgatt.app or the cancellation mechanism, with acknowledgment of receipt and refund of the price, without any usage conditions. The exception in that article for services whose performance date falls within the 10 business days following the purchase order will not be extended to periods whose start is later than that deadline. The commercial benefits below do not replace those rights.

2. 7-day commercial refund benefit on your first purchase

As an additional change-of-mind benefit, if this is the first time you buy access to sgatt.app, you can request a full refund if both of the following conditions are met:

• You request it within 7 calendar days of the purchase, and

• in that time you have answered fewer than 25 questions in practice mode and have not completed any section of the full exam.

This usage limit applies only to the change-of-mind commercial benefit: within its conditions we do not ask you to explain your reason. It does not restrict statutory withdrawal where it applies, nor your rights for non-performance, deficient performance, or defects of the Service; nor is it a quality guarantee limited to 7 days.

3. Extensions and later purchases

• As an additional commercial benefit, the 60-day extension is refundable if you request it within 7 calendar days of its purchase and the extended period has not yet started. Once that period starts, this commercial benefit ends, but the applicable legal rights remain, including withdrawal where it applies under section 1 and the remedies in section 4.

• A repeat purchase of a 30- or 120-day plan does not include the first-purchase commercial benefit, because you already know the Service. It keeps the legal rights described in sections 1, 4, and 8, even if its start is deferred because you still have active access.

4. Service failures attributable to SGATT

Independently of the commercial benefits, you keep the legal remedies for non-performance or deficient performance attributable to SGATT. Where the conditions of Articles 92 Bis and 92 Ter of the Federal Consumer Protection Law are met, a bonus or compensation of at least 20% of the price paid applies, without replacing any damages that may be owed or other legal remedies. We do not condition those rights on a minimum 48-hour interruption.

• As an additional benefit, if an interruption attributable to SGATT lasts more than 48 consecutive hours during your access period, you may choose to have us extend your access by the length of the interruption or refund the proportional part for those days. This option does not replace your legal rights for a shorter failure or any compensation that may apply.

• If we fail to deliver a substantial feature offered at the time of purchase, or we cannot continue the Service, you may request the refund corresponding to the service not provided and exercise the other applicable legal remedies. The proportional refund is calculated using the price of the affected period and the paid time that was not provided; it does not exclude a larger refund, bonus, or compensation where the law requires it.

• If there is an excess or duplicate charge, we will return the difference or the duplicate charge within 5 business days of your claim, in accordance with Article 91 of the Federal Consumer Protection Law, without prejudice to any legal interest owed if we exceed that deadline.

Problems that are exclusive to your connection or device and not attributable to SGATT do not by themselves give rise to a refund. Announced maintenance, a failure of our providers, or an error in a question do not automatically exclude our liability: we will assess whether there is non-performance or deficient performance and apply the law. We will address content reports; an isolated error does not by itself determine the scope of a refund.

5. Situations that on their own do not entitle you to a refund

• Not reaching the score you expected on the GMAT. sgatt.app is a practice tool; the result depends on many factors outside our control.

• Not using the access, or using it little, outside the first-purchase commercial benefit, unless withdrawal or another legal right applies.

• Changing your mind about your test date or study plan outside an applicable commercial benefit or withdrawal right.

• A suspension or cancellation for a breach attributable to the user does not automatically give rise to a refund, but neither does it remove legal rights or authorize automatic forfeiture of amounts paid; the cause and the service actually provided will be considered.

• Complimentary or promotional access free of charge.

6. How to request a refund

Write to support@sgatt.app with the subject “Refund” and state the email address of your account and the date or reference of the purchase; you may also use the cancellation mechanism for a withdrawal. We will verify your identity proportionately if necessary. You do not need to explain your reason to exercise a commercial benefit within its conditions or a statutory withdrawal. We will acknowledge receipt within a maximum of 2 business days and resolve within a maximum of 5 business days, without exceeding any shorter legal deadline or delaying a refund that is already due.

A refund that is granted will be processed through Stripe to the same payment method, unless technically impossible, in which case we will agree with you on a lawful method at no additional cost. We will send you confirmation of the refund; the time your bank takes to reflect it may vary and does not justify SGATT delaying a legal deadline. A full refund of the active period ends that access; a refund of an extension that has not yet started removes only that extension, and a partial refund or a refund for an improper charge does not remove the remaining access you have paid for. If we issued an invoice, we will carry out the cancellation, substitution, or credit-note CFDI that corresponds for tax purposes to the amount refunded.

7. Disputes with your bank (chargebacks)

You can contact us if you have a problem with a charge, without this being a requirement for disputing it with your bank. A good-faith claim is not penalized. If a payment is actually reversed or cannot be confirmed, we may proportionately suspend the corresponding access while it is clarified, informing you of the reason. We will restore access and adjust the period where appropriate if the payment is confirmed, without limiting your rights before the card issuer or the authorities.

8. Your rights as a consumer

You may at any time turn to the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor, PROFECO) through its channels and Consumer Defense Offices. Concilianet will be available for this relationship if SGATT participates in the system and the claim falls within its scope. This Policy does not replace or restrict your legal rights.
