sgatt.app Terms and Conditions of Use
Version 2.0 · Effective date: pending
Version 2.0 — Incorporates the external legal review of October 7, 2026. Planned effective date: [launch date].
This is a courtesy translation. The Spanish version (“Términos y Condiciones de Uso”) is the legally binding one and prevails in case of any discrepancy.
These Terms and Conditions (the “Terms”) govern access to and use of the sgatt.app platform (the “Service”), operated by [FULL NAME AS SHOWN ON THE TAX REGISTRATION CERTIFICATE], an individual with business activity, Mexican tax ID (RFC) [RFC], with address for purposes of these Terms at [FULL ADDRESS], Mexico City, Mexico (“SGATT”, “we”, “us”). Before you create your account and before you buy, these Terms and the Refund Policy will be available for you to read and save. Your acceptance is collected through an affirmative action on the corresponding form and is recorded with its date and version. If you do not agree, do not complete the sign-up or the purchase.
You can reach us at support@sgatt.app and at [CUSTOMER SERVICE PHONE NUMBER, WITH COUNTRY AND AREA CODE] for anything related to the Service, including payments, refunds, invoicing, and personal data protection. The full address and these contact channels will be available before purchase.
1. What the Service is
1.1. sgatt.app is an online practice and calibration platform for preparing for the GMAT exam, formerly known as the GMAT Focus Edition. It offers a bank of 600 original questions with explanations, a practice mode that records confidence and error causes, a full-length exam simulation with a per-section clock, and performance reports.
1.2. The Service is a practice supplement. It is not a complete course, it does not replace the official materials of the Graduate Management Admission Council (GMAC), and it does not guarantee any score on the real exam.
1.3. The scores shown by the simulation (60–90 per section and 205–805 in total) are approximate estimates calculated on a three-level difficulty scale. They are not predictions of your official score and should not be used to decide your test date or presented to any institution.
1.4. GMAT® is a registered trademark of the Graduate Management Admission Council (GMAC). SGATT is not affiliated with GMAC and is not sponsored, endorsed, or approved by it. Other trademarks mentioned belong to their respective owners.
1.5. The Service’s interface, questions, and explanations are in English, like the exam. The home page and the legal documents are available in Spanish and English.
2. Account
2.1. To use the Service you need to create an account with a valid email address and a password. You must be at least 18 years old.
2.2. The account is personal and non-transferable. Only one user per account is allowed. Do not share your password or let third parties use your account. You are responsible for misuse that is attributable to you under the law; the mere fact that an activity appears on your account does not make you responsible for unauthorized access. Notify us immediately at support@sgatt.app if you suspect unauthorized access.
2.3. The information you provide must be truthful and up to date. We may suspend accounts created with false information or duplicated to circumvent these Terms.
2.4. You can cancel the Service immediately through [CANCELLATION PATH OR BUTTON IN YOUR ACCOUNT]. Before you confirm, you will be shown the effects on your access and on any pending periods; you will receive a confirmation of the cancellation. You can also request closure of your account at support@sgatt.app. Cancelling the Service or closing your account does not by itself entitle you to a refund: the Refund Policy and your legal rights apply. Data deletion is handled in accordance with the Privacy Notice; it does not remove records we are required to keep by law.
3. Plans, prices, and payment
3.1. Access to the Service is sold for fixed periods, not as a subscription. At the time this version is published, the plans are:
| Plan | Duration | Price |
|---|---|---|
| 30-day access | 30 calendar days | MXN $500 |
| 120-day access | 120 calendar days | MXN $1,300 |
| 60-day extension | 60 additional calendar days | MXN $500 |
Prices are in Mexican pesos and include applicable VAT (IVA). Before you confirm payment, you will be shown the total price, taxes, and any mandatory charges, as well as the plan, its duration, and its start and end dates. The total you accept is what you will pay; we do not add mandatory charges afterwards. We may change prices for future purchases; a change never affects a period already paid for.
3.2. There is no automatic renewal and no recurring charges. When your period ends, access closes; we do not charge you anything further unless you buy another plan. Your practice data is kept in accordance with the Privacy Notice, so if you buy again you recover your history.
3.3. The access period starts when payment is confirmed. If you buy a plan or an extension while you still have active access, the new days are added from the date your current access ends; they are not lost. The 60-day extension can only be bought if you have made a previous purchase. Before paying you will know when the purchased period starts and ends. We will send you a confirmation with the plan, amount, currency, dates, purchase reference, and a downloadable copy of these Terms and of the Refund Policy you accepted. Purchases with a deferred start keep whatever statutory withdrawal rights apply.
3.4. Payments are processed through Stripe. SGATT does not receive or store your full card number or its security code. Before paying you will have access to Stripe’s information and to the Stripe terms applicable to payers, as well as to its privacy policy (https://stripe.com/privacy). The available payment methods are those Stripe shows on the checkout screen. Using a payment processor does not release SGATT from its obligations as provider of the Service.
3.5. Invoice (CFDI). You can request one at support@sgatt.app, providing your RFC, name or company name, tax postal code, tax regime, and CFDI use. We do not condition issuance on requesting it within the same month, on presenting your Tax Status Certificate (Constancia de Situación Fiscal), or on paying an additional fee. You can also request it by phone through the customer service number; an email address to receive it is optional. Transactions with the general public are documented in accordance with tax regulations. If a purchase has already been included in a global CFDI, we will make the applicable tax adjustments to issue the individual invoice.
3.6. We may grant complimentary or promotional access free of charge. Such access is governed by these Terms, is not redeemable for money, and may be withdrawn if the Terms are breached.
4. Refunds
Refunds are governed by the Refund Policy published on sgatt.app, which forms part of these Terms. In summary: we offer a commercial refund benefit of 7 calendar days on your first purchase, subject to limited use; extensions are refundable within 7 calendar days of purchase as long as the extended period has not started. These benefits are in addition to statutory withdrawal where it applies, to the remedies for non-performance or deficient performance, and to the return of improper charges. No usage limit or commercial deadline restricts the rights granted to you by the Mexican Federal Consumer Protection Law (Ley Federal de Protección al Consumidor).
5. Permitted and prohibited use
5.1. We grant you a limited, personal, non-transferable license to use the Service and its content for personal preparation purposes during your access period. It may end early only for the justified causes set out in these Terms or provided by law, respecting your rights as a consumer.
5.2. Without SGATT’s prior written authorization, and without prejudice to uses expressly permitted by law, it is prohibited to:
copy, photograph, transcribe, bulk-download, publish, sell, or distribute the questions, explanations, passages, charts, and other protected content of the Service, in whole or in part; this restriction does not grant SGATT exclusive rights over ideas, formulas, methods, or mathematical rules;
share your account or allow others to use it;
use automated programs, scrapers, extensions, or any technical means to extract content or access the Service;
use the protected content of the Service to train, fine-tune, or evaluate artificial intelligence models, or to create question banks, courses, or competing products, except with authorization or where permitted by law;
circumvent the paywall, access controls, or any technical protection measure;
attempt to decompile, reverse-engineer, or access the source code of the Service, except to the extent expressly permitted by law;
interfere with the operation of the Service, overload it, or introduce malicious code;
use the Service for unlawful purposes or in violation of third-party rights.
5.3. Where there is documented evidence of a material breach, we may suspend access proportionately and tell you the cause and how to clarify or correct it. We may cancel the account if the breach is serious or persists. If there is an immediate security risk or a legal requirement, we may act first and notify you as soon as possible. There is no automatic forfeiture of amounts paid: any refund or liability will be determined in accordance with the law and the Refund Policy. Filing a complaint or exercising a right is not a breach.
6. Intellectual property
6.1. The original and protectable elements of the Service —questions, explanations, passages, tables, charts, texts, design, and software— belong to SGATT or its licensors, to the extent of the rights that actually correspond to them, and are protected by the Mexican Federal Copyright Law (Ley Federal del Derecho de Autor) and applicable treaties. Trademarks and other distinctive signs are protected under the Federal Law for the Protection of Industrial Property (Ley Federal de Protección a la Propiedad Industrial). Ideas, formulas, methods, mathematical rules, and public-domain materials do not become SGATT’s exclusive property; nor do third-party trademarks.
6.2. These Terms do not transfer any intellectual property rights to you. All rights not expressly granted are reserved to SGATT.
7. Content you contribute
7.1. The Service lets you submit comments, ratings, and opinions about questions, sessions, or the simulated exam (“Feedback”). You keep whatever rights you hold in it. By submitting Feedback you authorize, on a non-exclusive basis and without payment, its reproduction and internal use to address it, correct content, and improve the Service, for as long as necessary for those purposes in accordance with the Privacy Notice. You do not authorize its publication as a testimonial and you do not assign your moral rights. De-identified analyses that can no longer identify you may be kept to improve the question bank.
7.2. Testimonials. We will only publish your Feedback where other people can see it if you check a separate, optional box, unchecked by default, that authorizes that publication and the use of your first name and program of interest. We will label it as a testimonial and respect the meaning of your opinion. You can withdraw the authorization at any time by writing to support@sgatt.app; we will remove the publication from our channels without delay and within 15 business days at the latest, without retroactive effect on earlier lawful uses. Declining does not affect your access or support.
7.3. You warrant that your Feedback is your own, does not infringe third-party rights, and does not contain other people’s personal data.
8. Availability, changes, and maintenance
8.1. We strive to keep the Service continuously available. There may be interruptions or errors, which we will address; the Service depends on infrastructure providers (hosting, database, payments, email). That dependence does not shift the risks of our operation onto the consumer or exclude the liability that legally corresponds to SGATT.
8.2. We may fix errors, update questions, and add improvements, provided that during an already-paid period we maintain the substantial features offered at the time of purchase. We will not unilaterally withdraw or reduce those features. If we cannot deliver them, we will inform you and you may exercise the remedies provided by law and by the Refund Policy.
8.3. As an additional benefit, if an interruption of the Service attributable to SGATT lasts more than 48 consecutive hours during your access period, we will extend your access by the length of the interruption, or you may choose a proportional refund for those days. You can request it at support@sgatt.app. The 48-hour threshold does not condition your legal rights for deficient performance and does not replace any compensation or damages that may apply.
9. Warranties and liability
9.1. The Service is provided as a practice tool. SGATT does not promise that you will obtain a particular score or that you will be admitted to any program. Questions are reviewed but may contain errors: if you find one, report it from within the application or at support@sgatt.app and we will address and correct it. These clarifications do not exclude the obligation to provide the Service with the features offered, nor your legal rights for defects or non-performance.
9.2. SGATT’s liability will be determined in accordance with applicable law, including the consumer’s non-waivable rights and the remedies, compensation, and damages that legally apply. Academic or professional outcomes depend on factors outside the Service; their mere absence does not establish a breach. A claim for damages requires the elements and causal link required by law.
9.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the Federal Consumer Protection Law or other mandatory law.
10. Suspension and termination
10.1. Suspension or cancellation for breach is subject to section 5.3. We may also suspend the access corresponding to a payment that has actually been reversed or not confirmed, or when the law requires it, telling you the reason and considering your clarifications. If the payment is confirmed, we will restore access and adjust the period where appropriate. Merely filing a good-faith dispute or a complaint does not authorize a sanction or remove your rights.
10.2. If we decide to stop offering the Service, we will stop accepting new purchases and honor the periods already contracted. If a justified cause makes it impossible to honor them, we will inform you at least 30 calendar days in advance where possible and refund the part corresponding to the service not provided. This refund does not exclude other remedies, compensation, or damages that may apply under the law.
11. Communications
11.1. We will send you by email the communications necessary to provide the Service: account confirmation, password recovery, purchase confirmation, notice that your access is about to expire, changes to these Terms or to the Privacy Notice, and relevant incidents. These communications are not advertising and cannot be turned off while you have an account.
11.2. We will only send you commercial communications if you expressly agreed to them; you can unsubscribe at any time through the link at the bottom of each message or by writing to support@sgatt.app.
12. Changes to these Terms
12.1. We may publish new versions of these Terms, with their date, for future purchases. Periods already paid for keep the conditions accepted at the time of purchase, except for changes required by law or modifications you expressly accept. If we propose a substantial change for an active period, we will notify you by email at least 15 calendar days in advance and explain its effects.
12.2. Not accepting a proposed change does not end your access or alter the conditions of your paid period. In addition, if you prefer, in the face of a substantial change that harms you, you may choose to cancel and receive a proportional refund of the pending service, without prejudice to other legal rights. Merely continuing to use the Service does not imply acceptance of a substantial modification.
13. Privacy
The processing of your personal data is described in the Privacy Notice published on sgatt.app. Making it available and reading it do not amount to authorizing all processing: consents and choices about secondary purposes are collected in accordance with that Notice and the law.
14. Governing law and dispute resolution
14.1. These Terms are governed by the applicable laws of Mexico, including the Federal Consumer Protection Law, without excluding the mandatory consumer-protection provisions that may apply in a user’s country of residence.
14.2. You can write to us at support@sgatt.app if you have a complaint; we aim to resolve it within a maximum of 10 business days, without exceeding any shorter legal deadline. This is not a prerequisite for exercising your rights. As a consumer you may at any time turn to the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor, PROFECO) through its channels and Consumer Defense Offices. Concilianet may be used if SGATT participates in that system and the claim falls within its scope.
14.3. Any judicial dispute may be brought before the courts that are competent under the law, including those of Mexico City where applicable. This clause does not establish an exclusive forum and does not imply a waiver of the jurisdiction or protection mechanisms available to you as a consumer.
15. General provisions
15.1. If any provision of these Terms is declared invalid, the remaining provisions will remain in force.
15.2. These Terms and the Refund Policy make up the conditions of the Service, together with the features, promotions, and offers we are legally required to honor. They do not replace or restrict your legal rights. The Privacy Notice governs the processing of personal data and the corresponding consents.
15.3. These Terms are written in Spanish and translated into English as a courtesy. In case of discrepancy, the Spanish version prevails.
